Terms of Service

These Terms of Service govern your use of the Matchcast platform available at matchcast.app (the "Platform"). By creating an account or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Definitions

  • Operator — the entity operating the Matchcast Platform.
  • Platform — the Matchcast web application available at matchcast.app, including all its features and functionalities.
  • User — a natural person who has created an account on the Platform.
  • Account — an individual User profile protected by login credentials.
  • Group — a team of Users competing in shared prediction events.
  • Event — a sports result prediction competition created by a User within a Group.
  • Prediction — a User's forecast of the outcome of a sports match.
  • Premium Plan — a paid tier offering extended Platform features.

2. Eligibility and Registration

The Platform is available to individuals aged 16 or older. Individuals between 16 and 18 years of age should obtain consent from a legal guardian. Registration requires providing a name (display name), email address, password, and acceptance of these Terms. Users agree to provide accurate information and keep it up to date.

3. User Account

Users are solely responsible for maintaining the confidentiality of their login credentials and for all activities conducted through their Account. If you suspect unauthorized access, you should immediately change your password and notify the Operator. Each Account may only be used by one individual. Sharing Accounts with third parties is prohibited.

4. Description of Service

Matchcast enables Users to create Groups, organize sports match prediction Events, and compete in point-based rankings. The Platform offers a free Basic Plan with limited Groups and Events, and a Premium Plan with extended features. The Operator endeavors to ensure continuous Platform availability but reserves the right to conduct maintenance, updates, and feature modifications.

5. Prohibited Conduct

Users agree not to use the Platform in any manner that is unlawful or inconsistent with these Terms. Prohibited activities include: using the Platform for gambling or commercial purposes; publishing content that is offensive, vulgar, hateful, or infringes on the rights of third parties; attempting unauthorized access to Platform systems; using automated scripts, bots, or other tools that interfere with Platform operation; creating multiple Accounts to circumvent limitations; impersonating other individuals or providing false information.

6. No Gambling Disclaimer

Matchcast is not a gambling platform under any applicable gambling legislation. No monetary bets are placed or accepted, and no monetary prizes or material rewards are awarded for predictions. Predictions are made solely for entertainment and social purposes. Point-based rankings serve only to compare prediction accuracy among Users.

7. User-Generated Content

Users retain copyright to content they create on the Platform (Group names, Event descriptions). By publishing content, Users grant the Operator a non-exclusive, royalty-free, worldwide license to display, store, and process such content as necessary to provide the service. The Operator reserves the right to remove content that violates these Terms or applicable law without prior notice.

8. Intellectual Property

The Platform, including its source code, user interface, logo, icons, design elements, databases, and documentation, is the intellectual property of the Operator and is protected by copyright and other intellectual property laws. Copying, modifying, decompiling, reverse engineering, or using any elements of the Platform without the Operator's written consent is prohibited. Sports data displayed on the Platform originates from external sources and is subject to their respective licensing terms.

9. Plans and Payments

The Platform offers a free Basic Plan and a paid Premium Plan. Detailed pricing, feature availability, and payment terms are available on the pricing page. Payments for the Premium Plan are processed by a third-party payment processor (Stripe). The Operator does not store payment card data. Refund and cancellation terms are governed by the payment processor's terms and applicable consumer protection laws.

10. Limitation of Liability

The Platform is provided on an "as is" basis. The Operator does not guarantee uninterrupted, error-free operation or the accuracy of sports data sourced from third parties. To the maximum extent permitted by law, the Operator shall not be liable for: damages resulting from Platform downtime or data loss; decisions made based on information presented on the Platform; actions of third parties, including payment service providers; lost profits, indirect, or consequential damages. This limitation does not exclude or limit liability arising from mandatory provisions of Polish law.

11. Indemnification

Users agree to indemnify and hold harmless the Operator from any liability and costs (including reasonable legal fees) arising from violations of these Terms, applicable laws, or the rights of third parties.

12. Suspension and Termination

The Operator reserves the right to suspend or permanently block a User Account in case of Terms violations, suspected abuse, or actions detrimental to the Platform or other Users. In case of Account suspension, the User will be informed of the reasons and may appeal by contacting the Operator. Users may discontinue using the Platform at any time by deleting their Account.

13. Account Deletion and Data Removal

Users may request Account deletion at any time through Account settings or by contacting the Operator. Upon deletion request: personal data will be permanently removed within 30 days; predictions and ranking results will be anonymized (attributed to a deleted profile without identifying data); anonymized statistical data may be retained for analytical purposes. Details regarding data processing after Account deletion are provided in the Privacy Policy.

14. Changes to Terms

The Operator reserves the right to modify these Terms. Users will be notified of significant changes at least 14 days in advance via email or in-Platform notification. Continued use of the Platform after the changes take effect constitutes acceptance of the updated Terms. If you do not accept the changes, you have the right to delete your Account before the effective date.

15. Final Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Matters not covered by these Terms shall be governed by Polish law, in particular the Civil Code, the Electronic Services Act, and the Consumer Rights Act.

16. Governing Law and Jurisdiction

These Terms are governed by Polish law. Any disputes arising from the use of the Platform shall be resolved by the court competent for the Operator's registered office, subject to mandatory provisions regarding court jurisdiction for consumers. Consumers may also use out-of-court dispute resolution mechanisms, including the ODR (Online Dispute Resolution) platform at ec.europa.eu/consumers/odr.
